1. Agreement to Terms

By accessing or using kiraClaim's expense claims and overtime management platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and kiraClaim ("we", "us", or "our").

2. Service Description

kiraClaim provides a web-based platform that enables users to:

  • Submit and manage expense claims with receipt uploads
  • Record and calculate overtime (OT) pay based on Malaysian labour law
  • Generate monthly PDF reports for claims and OT records
  • Manage staff under an organisation (HR Admin role)
  • Scan receipts using AI OCR technology
  • Monitor approval status and claim history

Our Services are designed for legitimate business expense and workforce management purposes only.

3. Account Registration and Security

3.1 Account Creation

To use our Services, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain and update your information to keep it current
  • Have the legal authority to bind any business entity on whose behalf you use our Services

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised access or security breaches
  • Not sharing your account with others

4. Acceptable Use Policy

4.1 Permitted Use

You may use our Services only for lawful business purposes, including:

  • Submitting genuine employee expense claims and receipts
  • Recording and verifying overtime hours for payroll purposes
  • Managing staff claims and approvals within your organisation
  • Generating reports for internal accounting and HR records

4.2 Prohibited Use

You may NOT use our Services to:

  • Submit false, fabricated, or fraudulent expense claims or receipts
  • Manipulate OT records or salary calculations dishonestly
  • Upload harmful, malicious, or illegal content
  • Engage in fraudulent, deceptive, or illegal activities
  • Impersonate others or misrepresent your identity or role
  • Attempt to gain unauthorised access to other users' data
  • Scrape, harvest, or collect data without consent
  • Interfere with or disrupt our Services or servers
  • Reverse engineer, copy, or distribute our platform

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

5. Subscription and Payment

5.1 Subscription Plans

We offer multiple subscription tiers (Personal Free, Starter, Business, Lifetime) with different features and limits. Current pricing and plan details are available on our website.

5.2 Billing

  • All paid subscriptions are billed monthly or annually in advance
  • Prices are in Malaysian Ringgit (RM) unless otherwise stated
  • Payment is due immediately upon subscription or renewal
  • Failed payments may result in service suspension
  • You authorise us to charge your payment method automatically each billing cycle

5.3 Plan Changes

  • Upgrades: Take effect immediately
  • Downgrades: Take effect at the next billing cycle; no refunds for unused features

5.4 Price Changes

We reserve the right to modify our pricing. We will provide at least 30 days' notice of any price increases. Continued use of our Services after a price change constitutes acceptance of the new pricing.

6. Refund Policy

6.1 7-Day Money-Back Guarantee

First-time subscribers are eligible for a full refund if requested within 7 days of initial subscription. To request a refund:

  • Provide your account email and reason for refund
  • Refunds are processed within 5–7 business days

6.2 Refund Exclusions

Refunds are NOT available for:

  • Renewals or subscriptions beyond the initial 7 days
  • Account terminations due to Terms of Service violations
  • Unused portions of monthly subscriptions
  • Lifetime plan purchases (non-refundable)

6.3 Cancellation

You may cancel your subscription at any time from your dashboard settings. Upon cancellation:

  • You retain access until the end of your current billing period
  • No refund is provided for the remaining time
  • Auto-renewal is disabled
  • Your data is deleted 30 days after subscription ends

7. Data Ownership and Usage Rights

7.1 Your Data

You retain all ownership rights to your data (claims, receipts, OT records, staff information). You grant us a limited licence to use your data solely to provide our Services.

7.2 Our Rights

We own all rights to the kiraClaim platform, software, design, and branding. You may not copy, modify, distribute, or reverse engineer our Services.

8. Service Availability and Support

8.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

8.2 Support

  • Business plan: Priority support with faster response times
  • Support is provided in English and Bahasa Malaysia

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We provide our Services "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the past 12 months
  • We are not responsible for errors in OT calculations arising from incorrect data entered by users
  • Generated PDF reports are for internal record purposes only and do not constitute legal or financial advice

10. Indemnification

You agree to indemnify and hold kiraClaim harmless from any claims, damages, losses, or expenses arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of third-party rights
  • Your violation of applicable laws
  • Fraudulent or inaccurate data submitted through our Services

11. Termination

11.1 By You

You may terminate your account at any time by cancelling your subscription from your dashboard settings.

11.2 By Us

We may suspend or terminate your account immediately if:

  • You violate these Terms or our Acceptable Use Policy
  • Your payment method fails or account is past due
  • We suspect fraudulent or illegal activity
  • We are required to do so by law
  • We discontinue the Services (with 30 days' notice)

Termination for Terms violations does not entitle you to a refund.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12.2 Dispute Resolution

Before filing any legal action, you agree to first contact us to attempt to resolve the dispute informally via WhatsApp at +601-2626-6048.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our Services after changes constitutes acceptance of the updated Terms.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and kiraClaim.

14.2 Severability

If any provision of these Terms is found invalid, the remaining provisions remain in full effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not transfer or assign your rights under these Terms without our consent. We may assign our rights without restriction.
